1. General
Rosetic AI (“Rosetic,” “we,” “us,” and “our”) respects and is committed to protecting your privacy through our compliance with this Privacy Policy (the “Policy”). The words “you” and “your” refer to you as a visitor or user of the Platform (defined below).
This Policy describes:
- The types of information we collect from you or that you may provide when you visit the website(s) available at: https://www.rosetic.ai/, as well as any other websites or mobile applications directly owned by, or operated by or on behalf of, Rosetic where this Policy is linked (collectively, the “Website”).
- The types of information we collect from you or that you may provide when you use our development platform, APIs, related software, documentation, products, and tools directly owned by, or operated by or on behalf of, the Rosetic and where this Policy is linked (the “Services,” together with the Website, the “Platform”).
- Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Policy does not apply to information collected by us offline or through any other means, including on any other website operated by Rosetic where this Policy is not linked or by any third party, or information collected by any third party through any application or content (including advertising) that may link to or be accessible from the Platform (for further information, see below, “Third-party Websites”).
Please read this Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our policies and practices, then please do not use the Platform. By using the Platform, you agree to the terms of this Policy. This Policy may change from time to time (see below, “Changes to this Policy”). Your continued use of the Platform after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.
2. TERMS OF SERVICE
This Policy is incorporated by reference into and should be read in conjunction with our Terms of Service.
3. THE INFORMATION WE COLLECT
You are never legally required to provide Rosetic with any Personal Information. However, without your Personal Information, we may not be able to provide the Services, either in full or in part.
Personal Information. To ensure that we provide you with the best possible experience, we will store, use, and disclose personal information about you in accordance with this Policy. Personal information is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular user, household or device (“Personal Information”). The Personal Information that we may receive and collect depends on what you do when you visit the Platform.
Information of Other Individuals. You may have the opportunity to provide information of other individuals. When providing such information, you are solely responsible for obtaining the necessary consents and authorizations from any individuals in accordance with applicable data security laws and regulations, and Rosetic shall not be responsible or held liable for your failure to obtain the necessary consents.
Account Information. When you register to use the Services, we will collect, store, and use information about you and/or your company, which may include company name, your name, job title(s), postal address(es), telephone number(s), and email address(es).
Account Credentials. When you register to use the Services, you will be required to create a username and password that should only be known to you.
Inputs and Outputs. When you use the Services you will provide content, queries, code samples, chats, and similar details (“Inputs”) which will generate responses and actions (“Outputs”) from the Services based on your Inputs. This may include third-party applications you choose to integrate with our Services. If you include Personal Information or reference external content in your Inputs, we will collect that information and this information may be reproduced in your Outputs.
Credit Card Information. Please note that for any credit card information provided on the Platform, we utilize a trusted third-party PCI-DSS compliant payment processor to process all of your transactions and such payment processor collects and maintains the necessary Personal Information needed to necessitate such transactions. We do not maintain any credit card information on our systems.
Aggregated and De-Identified Data. We may collect, use and disclose aggregated and de-identified data such as statistical or demographic data for any purpose. Aggregated and de-identified data could be derived from your Personal Information but is not considered Personal Information under applicable law as this data will not directly or indirectly reveal your identity. However, if we combine or connect aggregated or de-identified data with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information which will be used in accordance with this Policy.
Free-Text Boxes. The information that you provide in each case will vary. In some cases, you may be able to provide Personal Information via email or free text boxes, such as contacting Rosetic to request further information. When providing your Personal Information, please provide only relevant information and do not provide unnecessary sensitive information, such as Social Security numbers, credit card information or other sensitive personal data, unless required for our services.
Recording Use of the Platform. From time to time, we may partner with trusted third-party vendors to analyze performance and traffic of the Platform. This may include things like buttons you click, mouse movements and other behavior on the Platform, date and time of access, pages visited, web beacons, and cookie or pixel tag information. Please see our “Cookies and Similar Technologies” section below to learn more about cookies, pixels tags, and analytic technologies.
(a) Information We May Collect on the Platform
You may have the opportunity to provide Personal Information on the Platform, including but not limited to:
If you provide any additional Personal Information beyond what we require, such as in your communications with us, doing so is entirely your choice. We will retain the Personal Information that you choose to provide in those instances.
If you are granted access to the Services through an employer, we do not require any Personal Information other than as set forth herein. If you have any questions or concerns about the ability of any corporate entity to access your Personal Information or furnish your Personal Information to us, you should direct those questions to the administrator of that corporate entity.
We may obtain the Personal Information listed above from the following categories of sources:
- Directly from you. For example, when you:
- register yourself via the Platform;
- review or comment on our Services;
- upload other documentation to the Platform; or
- otherwise communicate with us, such as contacting us for more information.
- Indirectly from you. For example, through information we collect from you in the course of providing our Services to you.
- Directly and indirectly from activity on the Platform. For example, from Platform usage details that are collected automatically. For more information on automatic information collection, please review the “Cookies and Similar Technologies” section below.
- Third Party Sources. We may collect information about you from third party sources, such as our business partners or entities that direct you to or are available via the Services.
4. COOKIES AND SIMILAR TECHNOLOGIES
In addition to the information that you provide to us, we may also collect information about you during your visit to the Platform. We collect this information using automated tools that are detailed below. These tools may collect information about your behavior and your computer system, such as your IP address, device identifier, browser type and language, operating system, date and time stamp, session ID, internet service provider, data regarding network-connected hardware, the pages you have viewed, and the actions you have taken while using the Platform.
We may use this automatically collected information to: (i) conduct analyses about the Platform; (ii) associate the different devices you use; (iii) remember your browser or device; (iv) remember your preferences and interactions; (v) deliver relevant advertisements or other content; (vi) market our services to you; (vii) collect information about the Platform and Services; and (viii) log activity on the Platform. We may use these technologies for providing the Platform, Services, security, authentication, analytics, product or service improvement, fraud detection, and for other similar purposes.
Some of the tools we use to automatically collect information about you may include:
- Cookies. A “cookie” is a small data file transmitted from a website to your device’s hard drive. Cookies are usually defined in one of two ways, and we may use either (or both) of them: (1) session cookies, which do not stay on your device after you close your browser, and (2) persistent cookies, which remain on your device until you delete them or they expire.
- Analytics Services. The Platform may use Bing, Google Analytics, Google Audiences, Meta, LinkedIn, TikTok, Twitter, and others for audience measurement and analytics purposes. These analytics services may use cookies or similar technologies to collect information to help us analyze users and how they use the Platform. The information collected by these technologies is used to assess how often you visit the Platform, what pages you view when you visit the Platform, and what other websites you visited before coming to the Platform. Information generated by these services may be transmitted to and stored by these providers and they may use this information for purposes such as evaluating your use of the Platform, compiling statistics reports on the Platform’s activity, and providing other services relating to Platform activity and other internet usage. You may review Google’s data privacy practices for Google Analytics and data privacy practices for Google Tag Manager. To opt out of being tracked by Google Analytics, you may download and install the Google Analytics Opt-out Browser Add-on.
- Web Beacons. A Web Beacon is an electronic image. Web Beacons can track certain things from your computer and can report activity back to a web server allowing us to understand some of your behavior. If you choose to receive emails from us, we may use Web Beacons to track your reaction to our emails. We may also use them to track if you click on the links and at what time and date you do so. This information is only collected in aggregate form and will not be linked to your Personal Information. Please note that any image file on a webpage can act as a Web Beacon.
- Embedded Web Links. Links provided in our emails and, in some cases, on third-party websites may include tracking technology embedded in the link. The tracking is accomplished through a redirection system. The redirection system allows us to understand how the link is being used by email recipients. Some of these links will enable us to identify that you have personally clicked on the link and this may be attached to the Personal Information that we hold about you.
Of course, if you do not wish to have cookies on your devices, you may turn them off at any time by modifying your internet browser’s or device’s settings. Please refer to the help section of your browser or mobile device for additional information. Your browser or mobile device may also offer add-ons, plugins, or extensions to manage cookies, local storage objects, scripts, or similar technologies mentioned in this Policy. Apple and Android mobile devices each generate an advertising identifier that can be accessed by apps and used by advertisers in much the same way that cookies are used on websites. Each operating system provides options to limit tracking and/or reset the advertising ID. However, by disabling cookies on your browser or device, you may be prohibited from full use of the Platform’s features or lose access to some functionality.
5. HOW WE USE YOUR INFORMATION
The Personal Information we gather and that you provide is, without limitation, used for the following purposes:
- providing, maintaining and facilitating the Services;
- creation and administration of your Rosetic account;
- facilitating payments for the Services;
- debugging and identifying and repairing errors that impair the functionality of the Services;
- security or fraud prevention purposes;
- providing you with appropriate customer service;
- developing new products and services;
- contacting you with special offers and other information we believe will be of interest to you (in accordance with any privacy preferences you have expressed to us);
- contacting you with information and notices related to your use of the Platform;
- improving the content, functionality and usability of the Platform;
- improving our Services and related products; and
- any other purpose identified at the point of data collection, in an applicable privacy notice, in a click-through agreement or in any other agreement between you and us.
Inputs and Outputs. We may use Inputs and Outputs to further train and improve our Services, unless you opt out through your account settings. Even if you opt-out, we will use Inputs and Outputs for model improvement when you directly report the materials to us (for example via our feedback mechanisms).
Duration. The length of time Rosetic retains Personal Information, including sensitive Personal Information, if any, is for as long as reasonably necessary to carry out Rosetic’s intended purpose for such information. When your Personal Information is no longer required by us, we and our service providers will perform the necessary procedures for destroying, deleting, erasing, or converting it into an anonymous form as permitted or required under applicable laws.
6. HOW WE DISCLOSE YOUR INFORMATION
We may disclose your Personal Information to a third party for a business purpose, including the following categories of third parties:
- Our Affiliates. We may disclose the information collected through the Platform with our affiliates, subsidiaries, and other related entities in order to provide the Platform and our Services as well as to provide you with appropriate customer support.
- Third-party Service Providers. We may disclose Personal Information collected through the Platform with third-party Service Providers who act for or on behalf of Rosetic. These third parties may need information about you to perform their functions. “Service Providers” may include suppliers, companies and consultants that provide website hosting, development, payment processing, data analytics, information technology and related infrastructure support, customer service, email delivery, and auditing.
- LLM Providers. Our Service Providers include third-party large language model (“LLM”) providers. As of the Effective Date, Rosetic’s LLM providers include OpenAI, Gemini, and Anthropic.
We do not sell, trade, share, or rent your Personal Information to unaffiliated third parties, as the foregoing terms are defined under applicable law.
Except as described in this Policy, we will not disclose your information with other third parties without your notice and consent, unless it is under one of the following circumstances:
- Legal Reasons.
- We believe that disclosure is reasonably necessary to comply with any applicable law, regulation, subpoena, or court order;
- To respond to duly authorized information requests from law enforcement or other governmental authorities;
- To enforce our agreements or policies;
- To investigate and prevent security threats, fraud, or other malicious activity; or
- To respond to an emergency that we believe in good faith requires us to disclose such information to assist in preventing the death or serious bodily injury of any person or Rosetic employee.
- Sale of Business or Merger. There are circumstances where Rosetic may decide to buy, sell, or reorganize its business. Under these circumstances, it may be necessary to disclose or receive Personal Information with prospective or actual purchasers, acquisition targets, partners or affiliates. In such circumstances, Rosetic will ensure your information is used in accordance with this Policy.
- In Aggregate or De-Identified Form. We may aggregate or otherwise anonymize the data we collect for purposes of analytics, research, marketing and other business interests of Rosetic. Such use shall not include Personal Information or information that can identify you as an individual or reasonably be used to identify you.
7. RIGHTS AND CHOICES
Depending on where you live and the laws that apply in your country of residence, you may enjoy certain rights regarding your Personal Information, as described further below. However, please be aware that these rights are limited, and that the process by which we may need to respond to any of your requests regarding our training datasets are complex. We may also decline a request if we have a lawful reason for doing so. Subject to the foregoing, Rosetic will comply with all applicable privacy laws.
Any Personal Information that we collect is processed in the legitimate interest of our business and for purposes of providing our Services to you as the lawful basis of such processing. As applicable, you may withdraw your consent to our processing of your Personal Information at any time or otherwise exercise any of the following rights, subject to verification of your identity, by notifying us as described below:
- Automated Processing and Decision-Making. You may email us at hello@rosetic.ai to request that we stop using your Personal Information for automated processing, such as profiling. In your email, please explain how you wish us to restrict automated processing of your Personal Information. When such restrictions are not possible, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your Personal Information.
- Correction or Rectification. You can correct what Personal Information we maintain by accessing your account directly (as applicable), or by emailing us at hello@rosetic.ai to request that we correct or rectify our files. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause information to be incorrect.
- Restrict Processing. When applicable, you may restrict the processing of your Personal Information by submitting a request via email to hello@rosetic.ai. In your email, please explain how you wish us to restrict processing of your Personal Information. When such restrictions are not possible, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your Personal Information. Where applicable, we will ensure such changes are shared with trusted third parties.
- Object to Processing. When applicable, you have the right to object to the processing of your Personal Information by submitting a request via email to help@rosetic.ai. When such objections are not possible, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent to the processing of your Personal Information. Where applicable, we will ensure such changes are shared with trusted third parties.
- Portability. Upon request and when possible, we can provide you with copies of your Personal Information. You may submit a request via email to hello@rosetic.ai. When such a request cannot be honored, we will advise you accordingly. You can then choose to exercise any other rights under this Policy, to include withdrawing your consent.
- Deletion. If you should wish to cease use of our Services and have your Personal Information deleted, then you may submit a request by emailing us at hello@rosetic.ai. Upon receipt of such a request for erasure, we will confirm receipt and will confirm once your Personal Information has been deleted.
8. COMMUNICATION PREFERENCES
We want to provide you with relevant information that you have requested. When possible, we will always provide options as to what information we collect and how you can manage any preferences that pertains to such information.
If we provide an opt-in service, such as newsletters, we will allow you to make choices about what information you provide at the point of information collection or at any time after you have received a communication from us while you are subscribed. Transactional or service-oriented messages, such as delivery confirmation messages, are usually excluded from such preferences, as such messages are required to respond to your requests or to provide goods and services, and are not intended for the purposes of marketing.
From time to time, we may send you informational newsletters and marketing emails. You may opt out of them at any time by selecting the “unsubscribe” link at the bottom of each email. Please note that by opting out or unsubscribing you may affect other services you have requested we provide to you, in which email communication is a requirement of the service provided. Even if you opt-out of receiving marketing material, we may still need to contact you with important information about your account or responding to your requests or questions.
9. ACCESS, CORRECTION, AND DELETION OF YOUR PERSONAL INFORMATION
Access, Correct, and Delete. If we provide you the option to create an account, you can access, correct, or delete some of the Personal Information we have collected or that you have provided to us by logging into your account and accessing the information displayed in your profile or account settings. If you do not have an account with us, please contact us at help@rosetic.ai to request the access, correction, or deletion of your Personal Information. Before we can process your request regarding your Personal Information, we may need to verify your identity to ensure the security and integrity of your Personal Information. Additionally, certain laws and regulations may require us to retain specific Personal Information or limit the scope of your request, even after verification. In such cases, we will inform you about any restrictions that apply.
Location Data. You may disable location services through your device’s settings at any time. However, doing so may limit or disable certain features of the Platform, including compass orientation and property address association features. The Platform collects location data only while actively in use for scanning purposes.
Push Notifications. You may opt out of push notifications at any time through your device’s settings.
Voice Data. If the Platform includes optional voice-enabled features, you may choose not to use them. The Platform will not access the device microphone without your explicit permission through the standard iOS or other device permission dialog. You may revoke microphone access at any time through your device’s settings.
10. CHILDREN’S INFORMATION
We do not knowingly collect or use information from individuals under the age of eighteen (18) without parental or guardian consent. We do not target the Platform to minors, and would not expect them to be engaging with the Platform or our Services. We encourage parents and guardians to provide adequate protection measures to prevent minors from providing information unwillingly on the internet. If we are aware of any Personal Information that we have collected about minors, we will take steps to securely remove it from our systems.
11. FEEDBACK
We welcome inquiries or feedback on the Platform and Services. Any inquiries, feedback, suggestions, or ideas you provide to us (collectively, “Feedback”) will be considered Rosetic proprietary material and will be treated as non-confidential. You should not submit any content you do not wish to make available to the general public, and you must take special care to make sure your Feedback comply with our Terms of Service or other applicable agreements. All terms and conditions of our Terms of Service apply to Feedback on or through the Platform. In particular, your Feedback must not violate the privacy or other rights of others. You may not use false identifying information or contact information, impersonate any person or entity, or otherwise mislead us as to the origin of any Feedback.
12. THIRD-PARTY WEBSITES
This Policy does not apply to websites or other domains that are maintained or operated by third parties or our affiliates. The Platform may link to third-party websites and services. These links are not endorsements of these websites, and this Policy does not extend to them. Because this Policy is not enforced on these third-party websites, we encourage you to read any posted privacy policy of the third-party website before using the service or website and providing any information.
13. YOUR RIGHTS UNDER STATE LAW
California.
- Shine the Light law. California Civil Code Section § 1798.83 permits users of our Platform that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to hello@rosetic.ai.
- Do Not Track and Global Privacy Control Signals. Other than as disclosed in this Policy, the Platform and Services do not respond to Do Not Track signals and does not operate any differently when it receives Do Not Track signals from your internet web browser. Rosetic’s Platform does however respond to the Global Privacy Control signal, which turns off sharing of non-necessary cookies for the browser sending the signal.
Nevada.
Nevada law permits customers in Nevada to opt-out of the sale of certain kinds of Personal Information. We do not sell your Personal Information to third parties as defined in Nevada law. If you are a Nevada resident and have any questions, you can contact us at hello@rosetic.ai.
14. LOCATION OF THE PLATFORM AND SERVICES
We do not warrant or represent that this Policy or the Platform’s use of your Personal Information complies with the laws of every jurisdiction. Furthermore, to provide you with our services, we may store, process, and transmit information in the United States and other locations around the world, including countries that may not have the same privacy and security laws as yours. Regardless of the country in which such information is stored, we will process your Personal Information in accordance with this Policy.
Supplemental Disclosure for Residents of Canada
Consent. By consenting to this Policy, you confirm you have read, understand, and consent to the collection, use, processing, and disclosure of your Personal Information in accordance with this Policy and understand that, in jurisdictions where it is available, Rosetic also relies on other lawful bases for the foregoing as more fully set out in this Policy. We will only collect, use and disclose your Personal Information with your consent, unless otherwise permitted or required by law. Your consent may be given expressly or implied, depending on the circumstances and the sensitivity of the information involved. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice.
Cross-Jurisdictional Transfer. By providing us with Personal Information, you acknowledge and agree that your Personal Information may be transferred or disclosed to other jurisdictions for processing and storage outside of Canada, including to the United States, where laws regarding the protection of Personal Information may be less stringent than the laws in your jurisdiction. You acknowledge and agree that we may disclose your Personal Information in these jurisdictions in response to legal processes or where we believe in good faith that disclosure is required or permitted by law.
15. DATA TRANSFERS FROM THE EEA
When you access the Platform or Services, your Personal Information may be transferred to our servers in the United States, or to other countries outside the European Economic Area (“EEA”) or the UK. This may be a direct provision of your Personal Information to us, or a transfer that we or a third party make. Where information is transferred from the EEA or UK, we ensure it is adequately protected by relying on: (1) adequacy decisions from the European Commission under Article 45 GDPR (or equivalent decisions under other laws) where they recognize that a country outside of the EEA offers an adequate level of data protection, and we may transfer your information to certain countries with adequacy decisions; or (2) standard contractual clauses which the European Commission has approved as contractual clauses under Article 46 GDPR that allow companies in the EEA to transfer data outside the EEA, and which we may utilize to transfer information to certain affiliates and third parties in countries without an adequacy decision.
16. SAFEGUARDING THE INFORMATION WE COLLECT
We use reasonable technical, administrative, and physical safeguards in order to protect your Personal Information against accidental loss and from unauthorized access, use, alteration, and disclosure. However, we can never promise 100% security. Please notify us immediately of any actual or suspected unauthorized use of the Platform or your information.
17. CHANGES TO THIS POLICY
This Policy describes our current policies and practices with regard to the information we collect through the Platform. We are continually improving and adding to the features and functionality of the Platform along with our Services offered through the Platform. If we make any changes to this Policy, a revised Policy will be posted on this webpage and the date of the change will be reported in the “Effective Date” above. You can get to this page from any of our webpages by clicking on the “Privacy Policy” link (usually at the bottom of the screen). We may also contact you by email using the email that you have provided to us.
